Development Plan Regulations laid before the Scottish Parliament

New development planning regulations were laid before the Scottish Parliament on Friday 19th December 2008. These provide additional legislative detail in support of the implementation of the .

The two main elements of secondary legislation of relevance to the Strategic Development Planning Authority (SDPA) are:

Subject to parliamentary processes, these are due to come into force on 28 February 2009.This will be the date of the commencement of the new development plan system in Scotland.

Development planning has been placed firmly at the heart of the modernised planning system and the Aberdeen City and Shire SDPA are breaking new ground with the emerging structure plan, seeking to reflect the Scottish Government's aspirations for the new system.

Implications for the emerging structure plan

Of particular relevance to the ongoing work of the SDPA in preparing a new structure plan for the area is The Planning etc. (Scotland) Act 2006 (Development Planning) (Saving, Transitional and Consequential Provisions) Order 2008. This Order will govern the approval process for the plan during 2009.

It is currently anticipated that the finalised structure plan will be submitted to Scottish Ministers on or before 27 February 2009. This would mean that the plan would proceed to approval under the 1997 Act and 1983 Regulations (Article 2). If submission occurs after 27 February 2009 the plan would remain a structure plan but would go through a hybrid process to approval (Article 3).

The Order also enables structure plans to remain in force until replaced by a strategic development plan in SDP areas (Article 6) and local development plans to be prepared which are consistent with a structure plan in SDP areas (Article 7). This enables Aberdeen City and Aberdeenshire Councils to prepare local development plans to implement the emerging structure plan.
